TERMS OF USE

By booking a trip or boarding the High Sociétéa double-decker bus, you (“Guest”) agree to these Terms and Conditions (“Terms”). These Terms are designed to ensure a safe, enjoyable experience for all Guests while protecting Toronto Tea Tours Inc., operating as High Sociétéa (the “Company”). These Terms are the master copy and supersede any other information about our services appearing on our website, social media, advertisements, or third-party listings.

1. Booking & Payment
All bookings must be made through our official website (www.highsocietea.ca) or an authorized agent. A reservation is only considered confirmed once full payment has been received and successfully processed. After your payment clears, you will receive an electronic booking confirmation such as an e-ticket or voucher.

All prices are listed per person in Canadian Dollars (CAD) and include the full High Sociétéa experience, which covers transportation, afternoon tea service, and menu items, unless otherwise stated. Applicable taxes, including HST, are calculated and added at checkout unless explicitly noted otherwise.

Gratuities are not included in the trip price. While tipping is optional, it is encouraged as a way to recognize the hard work of our staff. At the end of each trip, servers will circulate with our onboard point-of-sale (POS) tipping system. One hundred percent of tips are pooled and shared equally among all onboard staff, including the driver, after credit-card processing fees are deducted.

We accept major credit cards, including Visa, MasterCard, and American Express, as well as other payment options displayed at checkout. Full payment is required at the time of booking. If you make a booking on behalf of others, you act as the Organizer and confirm that you have the authority to bind all Guests in your party to these Terms. You are also responsible for communicating all relevant trip details and these Terms to every Guest included in your booking.  Gift cards or vouchers issued by the Company are non-refundable and cannot be redeemed for cash. They remain valid for the period printed on the voucher, such as six or twelve months, and  can be applied toward any available trip date within that period. Lost or stolen voucher codes cannot be replaced; please treat vouchers like cash.

2. Duration & Experience Details
Each trip lasts approximately one and a half hours, which includes fifteen minutes for boarding and check-in followed by approximately seventy-five minutes of driving through the city while Guests enjoy sightseeing and tea service.

Our vehicle is a custom-designed double-decker bus with a panoramic glass roof and no seatbelts. Guests may stand or walk only when the bus is stopped. For safety reasons, everyone must remain seated while the bus is moving. Alcohol is neither served nor permitted on board as  we are not licensed to sell or allow alcohol. Our staff provide safety instructions at boarding, and
Guests must follow these instructions at all times.

3. Food & Beverages
High Sociétéa offers three fixed menu options: Traditional, Vegan, and Gluten-Free. No substitutions are available beyond these three offerings. Guests may not bring outside food or drinks on board.

We cannot guarantee an allergen-free environment. Menu items may contain or come into contact with common allergens such as nuts, dairy, gluten, or shellfish. Guests with food allergies assume all associated risks and are encouraged to bring any necessary medication, such as an epinephrine auto-injector (EpiPen).

4. Accessibility
The bus has eight steep steps leading to the upper deck. Wheelchair users may be accommodated on the lower deck, although these seats do not provide the same panoramic view as the upper deck. Due to space and safety restrictions, strollers and prams cannot be brought on board. Service animals are welcome in compliance with Ontario law. Children under the age of sixteen must be accompanied by an adult.

5. Cancellations & Rescheduling
Guests may cancel their booking fourteen days or more before the scheduled trip and receive a full refund. If you cancel within seven days of the scheduled trip, tickets are non-refundable; however, you may reschedule once within twelve months of the original date, subject to availability. No-shows or cancellations within twenty-four hours of departure result in a forfeited ticket with no refund or reschedule option.

The Company may cancel or modify a trip due to reasons such as severe weather, vehicle issues, safety concerns, insufficient bookings, or other circumstances beyond our control, including force majeure events. If the Company cancels a trip, Guests will be offered either a reschedule or a full refund of the ticket price. The Company is not responsible for additional expenses such as hotels or flights that you may incur due to a cancellation.

Events beyond our reasonable control, including but not limited to extreme weather, natural disasters, civil unrest, pandemics, road closures, or government action, do not make the Company liable for refunds beyond what is stated in this section.

6. Guest Conduct & Safety Rules
Guests must follow all safety instructions provided by staff at all times. Smoking, vaping, and open flames are strictly prohibited on board. Caution should be used when handling hot beverages. Aisles must remain clear of bags, coats, or other belongings. Unruly, disruptive, abusive, or intoxicated Guests may be refused boarding or asked to disembark mid-trip without refund. Parents and guardians are fully responsible for minors in their care.

High Sociétéa reserves the right, at its sole discretion, to refuse boarding or continued participation to any person whose behavior, condition, or actions may jeopardize the safety, comfort, or enjoyment of other Guests or staff, or who fails to comply with these Terms. No refunds will be provided in such cases.

7. Media & Photography
High Sociétéa may photograph or film trips for marketing, social media, and other promotional purposes. By boarding, you grant High Sociétéa the right to use your image and likeness worldwide, in perpetuity, without compensation. If you prefer not to appear in such media, please inform our staff at boarding. We will make reasonable efforts to seat you away from cameras or blur your image in editing, but we cannot guarantee complete exclusion.

You may appear incidentally in photos or videos taken by other Guests. Personal photography and live streaming are welcome, but extensive or commercial filming requires prior written permission from the Company.

8. Third-Party Providers (Urban Inc. & Others)
Our bus is provided by Urban Inc. and its affiliates. While we select trusted partners, High Sociétéa is not responsible for acts or omissions of third-party service providers, including transport operators and caterers. By booking, you agree that Urban Inc. and its affiliates bear no liability to you for accidents, injuries, delays, or losses arising from their services, except where liability is mandated by Canadian law.

9. Personal Property
You are solely responsible for your personal belongings during your trip. High Sociétéa is not liable for any loss, theft, or damage to your property. Items left behind will be held for up to fourteen days if found. Unclaimed items after this period may be donated or discarded at our discretion.

10. Limitation of Liability & Indemnity
Your participation in a High Sociétéa trip is at your own risk. To the fullest extent permitted by law, High Sociétéa, its owners, staff, and affiliates are not liable for injury, illness, death, property loss, delays, or consequential damages except in cases of gross negligence or willful misconduct. Your sole remedy for any proven claim is limited to the amount you paid for the trip. You agree to indemnify and hold harmless the Company, Urban Inc., and their affiliates from any claims or expenses arising from your actions or breach of these Terms. Nothing in these Terms limits rights you cannot waive under Ontario or Canadian consumer protection laws.

11. Governing Law & Venue
These Terms are governed by the laws of Ontario and Canada. Any dispute arising under or in connection with these Terms will be brought exclusively before the courts of Toronto, Ontario.

12. Changes to Terms
We may update these Terms from time to time. The version posted on our website at the time of booking will govern your trip. Your continued use of our services after any changes indicates our acceptance of the revised Terms.
